The relationship between an employer and employee is one that virtually all us experience on a daily basis. Whether you are the employer, employee or an independent contractor, you must consider your legal rights and obligations arising from the relationship, both during the period of employment and thereafter. In today's world, we should all become knowledgeable about the multitude of potential consequences which could arise as a result the employment decision. Particularly in the area of problem avoidance and prevention, each party should be aware of and plan for the variety of unforeseen contingencies which could effect drastic and irreversible financial and personal consequences arising from the employment relationship. Our office can help you implement a plan to offset those negative potential consequences. We routinely assist our business clients with a variety of employment related issues. For example, we provide advice to employers on terminations, discipline and response to harassment and discrimination complaints. We also prepare customized employment agreements which define and protect each party's rights and duties, both during the term of employment and after the relationship has ended. We also provide legal services to employees who are the victims of improper conduct by a member of management or fellow employee, or who are threatened with post-employment enforcement actions. If you or your business need legal advice and assistance in addressing employment issues, Mr. Bryant can help you. Relevant Legal Terminology: Restrictive Covenant - one or more provisions within an employment contract which seek to impose significant limitations on the employee's rights (for ex., not to compete with the employer or disclose information learned during employment) following a termination of the employment relationship. Such restrictions must be narrowly tailored, are subject to "strict scrutiny", and will be voided if they impose an unreasonable restraint of trade on the employee. |
