Beginning early in his career, Mr. Bryant developed a reputation as a valuable legal counselor and litigator in the area of creditor-debtor relations and collections. He conducted seminars and represented a number of large wholesale landscaping growers and sellers throughout north Georgia. His success with the landscape growers quickly led to an expansion of his creditor-debtor practice. A wide variety of businesses (new and old) have sought Mr. Bryant’s assistance over the years with every issue from educating managers and employees on creditor-debtor legal rights and obligations, to litigating large contract and account claims, to obtaining post-judgment collection of both large and small judgments. Particularly in the area of debt collection, the final result (getting $$ for clients) is all that really matters. Our final results through the years are evidenced by the hundreds of thousands of dollars we have collected on behalf of our clients. If you’re in need of legal advice and assistance on: (1) how to establish and maintain the best credit and collection procedures for your business; (2) which customized documents and agreements to use when advancing credit to customers; or (3) pursuing the collection of a valid debt, feel free to give us a call. Relevant Legal Terminology: Writ of Fiera Facias (Fi Fa) - a document which formally and publicly records a court's judgment within the county's real estate records. The FiFa will help protect the judgment holder's interest in any real property of the judgment debtor and will otherwise provide public notice that an outstanding judgment exits against the debtor. General Execution Docket or "GED" - Once a judgment is entered, it should normally be recorded in one or more county's GED books. Formally recording a judgment on the GED allows the judgment creditor to collect its judgment in the event the judgment debtor attempts to sell property in the county and otherwise "puts the world on notice" of the judgment debt. Post-Judgment Collection Procedures - a variety of legal procedures available for pursuit of judgment collection in Georgia, including: property levy & sale, interrogatories (written questions to the judgment debtor), notices to produce documents and things, bank and employment garnishment actions, and post-judgment discovery depositions.
