Mr. Bryant grew up with a strong exposure to construction practices and management. His father, and then older brother, were professional general contractors who ultimately joined forces to operate a successful Atlanta based commercial construction company. When he graduated law school, Mr. Bryant helped that company with all its legal needs, including successfully litigating several cases all the way through the Georgia appellate courts. Mr. Bryant further developed his skills in the construction law area over the last twenty-four years by representing numerous developers, tract builders, commercial and residential construction companies, subcontractors and material suppliers. He has handled hundreds of cases dealing with all aspects of construction law. He has secured numerous winning jury verdicts and has participated in every level of the construction claims and litigation process - all the way from lien filings, to binding arbitration, to jury trials, to representing clients in our appellate courts. He has also successfully represented a large number of home owners and business owners in claims against their builders for breach of contract, negligent construction and fraud. In short, Mr. Bryant and this office have the skills, knowledge and experience to provide all manner of legal services in the area of construction practices and litigation. Relevant Legal Terminology: Standard of Care - In most cases, in order to show defective or negligent construction, a plaintiff must present evidence from an expert witness as to the applicable "standard of care", or a showing of "that degree of care and skill as is ordinarily employed by other contractors under similar conditions and like circumstances." Binding Arbitration - one form of "alternative dispute resolution" which allows the parties to a conflict to elect to have their issues resolved by one or more arbitrators as opposed to a judge or jury. Typically, the underlying written contract between the parties (oftentimes an American Institute of Architects or "AIA" agreement in the area of construction services) will designate binding arbitration as the sole form of dispute resolution. Each party should carefully consider the potential benefits and risks of such a contractual provision prior to approving the contract.
